MIKE WATERSPORTS – COMPREHENSIVE REFUND & CANCELLATION POLICY

LEGAL PREAMBLE & BINDING AGREEMENT
This Refund and Cancellation Policy (“Policy”) is a legally binding addendum to the Mike Watersports Terms & Conditions. By completing a booking, providing payment information, or utilizing any services provided by Mike Watersports (“Company,” “We,” “Us”), you (“Customer,” “You”) acknowledge and explicitly agree to be bound by the terms outlined below.
This policy is strictly enforced. Claims of ignorance regarding this policy, or demands for exceptions based on personal circumstances not expressly covered herein, will be legally rejected.
1. THE “DEFAULT NON-REFUNDABLE” STANDARD
Unless explicitly stated otherwise within the specific sub-sections of this Policy, all sales, bookings, deposits, and transactions are final and non-refundable. If a specific event, circumstance, or customer grievance is omitted from this document, the contractual default is that no refund, credit, or compensation is owed by Mike Watersports.
2. CUSTOMER-INITIATED CANCELLATIONS
We understand that plans change; however, reserving a vessel or equipment prevents the Company from renting it to other customers. Therefore, the following timeline dictates refund eligibility:
- Standard Rentals (Jet Skis, Small Sea Boats, Watersports):
- More than 48 hours’ notice: 100% Refund (minus administrative processing fee).
- Less than 48 hours’ notice: 0% Refund. The entire booking amount is forfeited.
- Yacht Charters & Crewed Vessels:
- More than 14 days’ notice: 100% Refund of the deposit (minus administrative fees).
- 7 to 14 days’ notice: 50% Refund of the total charter cost (minus administrative fees).
- Less than 7 days’ notice: 0% Refund. The entire charter amount is forfeited.
Note: All cancellation requests must be submitted in writing via email to sales@mikewatersports.com and confirmed by our staff to be considered valid. Voice messages or social media DMs do not constitute a valid cancellation.
3. NO-SHOWS, TARDINESS, AND EARLY RETURNS
To prevent operational delays and financial loss, strict adherence to schedules is required.
- No-Shows: Failure to appear for your scheduled booking will result in an automatic 0% Refund.
- Tardiness: Your rental or charter time begins strictly at the scheduled departure time, not when you arrive. If you are late, your time on the water will be shortened accordingly. If you are excessively late (e.g., missing a scheduled departure), it will be treated as a No-Show. No prorated refunds will be issued for lost time.
- Early Returns (The “Seasickness” Clause): If a Customer chooses to return to the dock early for any personal reason—including but not limited to seasickness, fatigue, fear, cold weather, or interpersonal disputes among passengers—no partial refunds or credits will be issued. The Customer has purchased a block of time, not a guarantee of comfort.
4. WEATHER & MARITIME SAFETY CANCELLATIONS
Mike Watersports prioritizes life safety above all else.
- Company Discretion: The Company, represented by our Captains and Base Managers, reserves the sole and absolute right to cancel, delay, or recall any rental or charter due to unsafe weather, high winds, dangerous sea states, or lightning. Customers may not cancel for weather reasons if the Company deems the conditions safe.
- Remedy for Weather Cancellation: If Mike Watersports cancels your booking prior to departure due to weather:
- We will first attempt to reschedule your booking to a mutually agreeable time.
- If rescheduling is impossible during your stay in Cyprus, a full refund of the base rental cost will be issued.
- Exclusion of Consequential Costs: Under no circumstances will Mike Watersports reimburse the Customer for secondary expenses incurred due to a weather cancellation, including but not limited to travel costs, taxi fares, hotel accommodations, or third-party booking fees.
5. REFUSAL OF SERVICE & RULE VIOLATIONS
As outlined in our Safety Protocols, Mike Watersports may terminate a rental or charter immediately, at any time, if the Customer or their guests:
- Appear intoxicated or under the influence of drugs.
- Act aggressively or abusively toward staff or other patrons.
- Violate maritime safety laws, the 100-meter distance rule, or the explicit instructions of the staff/Captain.
- Willfully damage Company property.
In the event of termination for any of the above reasons, the Customer will forfeit 100% of their payment. NO REFUNDS will be issued, and the Customer may still be liable for damages or retrieval fees.
6. MECHANICAL FAILURE VS. USER ERROR
- Company Fault (Mechanical Failure): If a vessel experiences a genuine mechanical failure (e.g., engine breakdown) that is not caused by the Customer, and the vessel cannot be repaired or replaced promptly, the Customer will receive a prorated refund or credit for the unused portion of their rental time.
- Customer Fault (User Error): If a vessel becomes inoperable due to the Customer’s negligence (e.g., sucking a tow rope into a jet ski intake, running the boat aground, ignoring engine alarm gauges, or flooding the engine), no refund will be issued for the lost time. Furthermore, the Customer’s security deposit will be seized, and they will be billed for all subsequent repair and salvage costs.
7. FORCE MAJEURE (ACTS OF GOD)
In the event that Mike Watersports is unable to fulfill a booking due to circumstances entirely beyond our control—including but not limited to government-mandated lockdowns, port closures by Cyprus authorities, severe natural disasters, or acts of war—bookings will not be legally entitled to a cash refund. Instead, the full value of the booking will be converted into a Voucher/Credit valid for a period of 12months from the original date of service.
8. CHARGEBACK ABUSE AND PAYMENT DISPUTES
By agreeing to these Terms, the Customer agrees not to initiate a fraudulent credit card chargeback to bypass this Refund Policy.
- If a Customer initiates a chargeback for a transaction that explicitly violates this written policy (e.g., initiating a chargeback because they were a “No-Show” or returned early due to seasickness), Mike Watersports will aggressively dispute the chargeback using this signed agreement.
- If the Company successfully defends the chargeback, the Customer agrees to be held liable for an administrative penalty of €150 to cover the legal and administrative costs of fighting the fraudulent dispute, which will be invoiced or charged to the card on file.
