MIKE WATERSPORTS – COMPREHENSIVE TERMS & CONDITIONS OF SERVICE

LEGAL PREAMBLE & BINDING AGREEMENT
Welcome to Mike Watersports. These Terms & Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Customer,” “Participant,” “You”), and Mike Watersports (“Company,” “We,” “Us”). These Terms govern your access to and use of our websites, as well as your booking, purchase, and participation in any rentals, charters, or services provided by Us.
BY ACCESSING THE SITE AND/OR BOOKING A SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL OF THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE OR OUR SERVICES.
1. BOOKING, PAYMENT, AND CANCELLATION POLICIES
To protect the Company from financial loss due to customer flakiness, the following strict policies apply to all transactions:
- Payment & Currency: All bookings must be paid in full (or the required deposit amount as specified at checkout) in Euros (€) to secure the reservation.
- Customer Cancellations & No-Shows: * Cancellations made with less than 48 hours’ notice will result in the forfeiture of the entire booking amount.
- “No-shows” (arriving late resulting in a missed departure, or failing to arrive entirely) are non-refundable under any circumstances.
- Weather & Safety Cancellations (Company Discretion): Mike Watersports reserves the absolute right to cancel, delay, or shorten any rental or charter due to unsafe weather, high sea states, or mechanical failure. In such events, the Company will attempt to reschedule. If rescheduling is impossible, a refund or credit will be issued. The Company is not liable for any secondary costs incurred by the Customer (e.g., travel, accommodation) due to a cancellation.
- Tardiness: Rental and charter times begin at the scheduled time, not the arrival time. Late arrivals will result in shortened service times without a prorated refund.
2. SECURITY DEPOSITS & FINANCIAL LIABILITY FOR DAMAGE
- Pre-Authorization / Damage Deposit: For self-drive sea boats, jet skis, and specific rentals, a valid credit card can be required to hold a pre-authorized security deposit. The amount varies by vessel and is explicitly stated at the time of booking.
- “You Break It, You Buy It” Clause: The Customer assumes absolute financial responsibility for any and all damage, loss of equipment, or excessive wear and tear caused to the vessel or equipment during their rental period, regardless of fault (e.g., hitting a submerged rock).
- Loss of Revenue (Demurrage): In the event a vessel is severely damaged and must be removed from service for repairs, the Customer agrees to compensate Mike Watersports for the documented loss of daily rental income during the repair period, up to the maximum value of the vessel.
- Retrieval & Salvage: If a Customer grounds a vessel, runs out of fuel due to ignoring gauges, or abandons the vessel outside of the designated operational zone, the Customer will be charged a minimum salvage/retrieval fee, plus hourly labor rates.
3. RIGHT OF REFUSAL & PARTICIPANT CONDUCT
- Absolute Discretion: Mike Watersports reserves the unilateral right to refuse service, terminate a rental early, or eject any passenger from a yacht charter—without refund—if they violate the Safety Protocols, appear intoxicated, act aggressively toward staff, or operate a vessel in a reckless manner.
- Integration of Safety Protocols: The separate “Safety Protocols & Assumption of Risk Policy” is hereby incorporated by reference into these Terms. A violation of the Safety Protocols is a material breach of these Terms.
4. THE “CATCH-ALL” DISCLAIMERS (Omissions & Errors)
To protect against claims that something was “omitted” or not explicitly warned against on the website:
- “As-Is” Website Disclaimer: The Site and all services are provided on an “AS-IS” and “AS-AVAILABLE” basis. We expressly disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Errors, Inaccuracies, and Omissions: We are not liable for any typographical errors, inaccuracies, or omissions on the Site, including pricing, descriptions, or availability. We reserve the right to correct any errors and to change or update information at any time, without prior notice. The failure of Mike Watersports to explicitly list every possible rule, hazard, or restriction on this website does not absolve the Customer of exercising common sense, adhering to general maritime safety, or strictly following staff instructions.
5. LIMITATION OF LIABILITY
- Liability Cap: To the maximum extent permitted by Cyprus and EU law, in no event shall Mike Watersports, its directors, employees, or agents be liable to You or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit or lost revenue.
- Maximum Financial Liability: Notwithstanding anything to the contrary contained herein, our absolute maximum liability to You for any cause whatsoever, regardless of the form of the action, will at all times be limited to the amount actually paid by You to Us for the specific service in dispute.
6. DATA PROTECTION (GDPR COMPLIANCE)
We respect your data privacy. By using our services, you consent to the collection and use of your personal data strictly for the purposes of processing bookings, communicating regarding your rental, and fulfilling legal/insurance obligations, in accordance with the EU General Data Protection Regulation (GDPR). 7. INTELLECTUAL PROPERTY
All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by Mike Watersports and are protected by EU copyright and trademark laws. You may not copy, reproduce, or distribute our Content without express written permission.
8. FORCE MAJEURE
Mike Watersports shall not be liable for any failure or delay in performance under these Terms resulting from acts beyond our reasonable control, including but not limited to acts of God, severe natural disasters, government restrictions, wars, pandemics, strikes, or major utility/internet failures.
9. GOVERNING LAW, JURISDICTION & SEVERABILITY
- Governing Law: These Terms, and any disputes arising out of your relationship with Mike Watersports, shall be governed by and construed strictly in accordance with the laws of the Republic of Cyprus.
- Exclusive Jurisdiction: Any legal action of whatever nature brought by either You or Us shall be commenced or prosecuted in the national courts located in Cyprus, and You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.
- Severability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
- Entire Agreement: These Terms, alongside the Safety Protocols and Privacy Policy, constitute the entire agreement and understanding between You and Mike Watersports, superseding all prior or contemporaneous communications and proposals, whether oral or written.
